GENERAL CONDITIONS FOR SHIPS

This ticket is non-transferable and is issued subject to the provisions of Law 20,094 of the Argentine Republic, in addition to the ticket regulations of this Company as stipulated herein. This ticket includes only the river transportation services and entails no obligation whatsoever by the carrier to render any additional services. In order to board the ship, passengers shall produce the corresponding ticket duly authorized by BUQUEBUS. The ticket is non-transferable and valid only for the date and time stated on it. With the exception of promotional rates with special conditions, tickets shall be valid for 365 days from the date of issue, after which time they will be no longer valid. The Company reserves the right to replace the stipulated ship and to modify schedules, itineraries and/or the duration of the trip, when circumstances so require it. Pursuant to current legislation, the Company disclaims any liability for Acts of God, force majeure affecting the ship, acts of the authority and/or acts of nature that prevent the trip from taking place on the date and/or the ship and/or the times and/or the service class as previously agreed. The service to be performed entails no obligation by the Company to use any ship in particular. The carrier reserves the right to change ships, even if they are not the type of ship as originally foreseen for a given frequency. Change of ships shall in no case give the passenger the right to any reimbursement or payment of a balance for lesser value received.
Any passenger who arrives with the intention of boarding a ship that is not the one indicated in their ticket shall be allowed to board if there is space available, and shall be required to pay any corresponding charge. Any person whose ticket is not paid for and/or has previous tickets unpaid shall be denied boarding. The Company reserves the right of admission of passengers.

CANCELLATIONS

In the event the passenger decides not to travel, they shall cancel their reservation with the Company in person or by phone as a minimum 12 hours prior to the ship’s scheduled departure, corresponding to the date and time indicated on the ticket. The ticket shall then be deemed open. Otherwise, the passenger shall lose the right to reimbursement of the ticket.

RETURNS

In the cases where the rates paid allow tickets to be returned, in order to return the ticket the passenger shall inform the Company of the cancellation of the ticket in person or by phone, as a minimum 24 hours prior to the ship’s scheduled departure corresponding to the date and time indicated on the ticket. The ticket shall then be deemed open ticket or else the passenger shall present it for reimbursement prior to the scheduled date. In such a case, the ticket price must be reimbursed within its valid period and shall be subject to a 30% withholding. The ticket holder shall lose the right to have the fare reimbursed if the ticket was not canceled within the specified term and in the manner required. Tour package tickets and/or special-offer tickets cannot be returned; if the passenger does not use them, they shall be deemed open tickets to be used up to their valid date.
Tickets purchased in Argentina shall be returned in Argentina; tickets purchased in Uruguay shall be returned in Uruguay. Tickets purchased in travel agencies that issue tickets shall be returned only at the same travel agency where the operation was conducted. Tickets purchased through Telephone Sales or Internet Sales shall be returned by sending an email to devoluciones@buquebus.com

 LUGGAGE

Passengers have the right to carry up to 30 Kg freight paid, and a maximum of two pieces of luggage per passenger. Any luggage that exceeds this allowance shall pay the corresponding surcharge as per weight and per piece of luggage. Only items for personal use, such as clothes and toiletries, shall be deemed to be luggage. In the event the passenger is carrying other items, the Company shall not be held responsible for their loss, damage or theft. If the passenger wishes to carry items outside the scope of what was described above, they shall declare such items when checking in their luggage; the Company reserves the right to include them as part of the luggage or to require that the passenger carry them on board. The Company disclaims any liability for compliance with customs regulations which, in all cases, shall be at the passenger’s sole risk and expense. The Company shall not be held liable for any luggage that is lost or misplaced, unless its value was declared by the passenger at boarding and verified by the ship’s purser.

LIMITATION OF RESPONSIBILITY

All limitations of liability contained in the pertinent laws and the International Treaties signed by the Argentine Republic shall apply to this passenger transport contract.

JURISDICTION

Any claim resulting from this ticket and/or as a consequence of the trip shall be subject to the exclusive jurisdiction of the Federal Courts of the City of Buenos Aires, Argentine Republic. APPLICABLE LAW: The laws of the Argentine Republic shall apply to this passenger transport contract and to any claim resulting therefrom.

LUGGAGE, INJURIES AND DEATH

Any claim referred to luggage, injury or death shall be subject to the Athens Convention of 1974 Relating to the Carriage of Passengers and their Luggage by Sea (the “Athens Convention”), in the manner in which it is incorporated to the internal laws of the Argentine Republic. The Athens Convention stipulates the limitation of liability with respect to luggage, injury or death.

BOARDING

Boarding shall be subject to the presentation of valid ID documents (see “Mandatory ID required in order to travel”). Boarding begins 2 hours prior to the ship’s departure. Starting 25 minutes before departure, the Company reserves the right to decline boarding. The provisions of articles 175, 325, 326, 331 and 337 of Law 20,094 shall apply to this ticket. The Company reserves the right to decline the boarding of automobiles, vehicles and/or cargo that exceeds the sizes that were declared and paid for with this ticket.
